SureSMS Anti-Spam Policy

At SureSMS we have a zero tolerance policy against spam. Spam is defined as unsolicited communication to mobile users who have not given their explicit consent (opt-in) to receive your SMS messages.

If we become aware that you are violating this policy, your account will be closed with immediate effect. If you suspect that one of our customers is violating our policies, please contact us via [email protected].

Requirements for consent

To use SureSMS, you only need to send SMS messages to recipients who have given a active consent. Consent can for example be obtained by:

  • The mobile user sends an SMS to a short code, e.g. 1245.
  • Sign up via a form on your website.
  • Accepting newsletters on your webshop or website.
  • Participation in competitions where it is clearly stated what the consent covers.

Failure to provide proof of consent is considered a material breach of the agreement and your account will remain closed.

Prohibited content

SureSMS does not allow SMS messages with the following content:

  • Pornography, escort services or material that exploits children under the age of 18.
  • Illegal goods, substances or activities, including pirated software and weapons manufacturing instructions.
  • Violent, racist, hateful, threatening, fraudulent or illegal material.
  • Content that violates intellectual property rights (copyright, trademarks, etc.).
  • Content that promotes products or services illegal in the recipient's location.
  • Links to viruses, malware or trojans.
  • Encouraged violence against individuals, groups or organizations.

Procedure in case of infringement

If we suspect spam, we will assess:

  1. The content of the sent SMS messages.
  2. The documentation of consent from mobile users.
  3. The spam complaint and how/if the complainant is signed up.

If we conclude that you have sent spam, your account will be permanently closed.

Received spam?

We do our utmost to prevent spam, but with over 10 million SMS messages sent every month, errors can occur. If you have received an unsolicited SMS, please:

  1. Unsubscribe via the instructions in the SMS message (regular SMS rate).
  2. Forward the content of the message and the sender's information to [email protected]so we can investigate and contact the customer.

Your safety and trust is our top priority. We do not tolerate any violation of this policy.
